Overview and Scope
This AssetView Public Website Terms of Use and Privacy Policy (this “Policy”) applies only to Public Websites (as defined herein) and does not apply to Services (as defined herein).
If there is any conflict between this Policy and the AssetView Products and Services Privacy Policy, the AssetView Products and Services Privacy Policy controls with respect to Services.

Key Definitions
- “AssetView,” “AV,” “we,” “our,” or “us” means AssetView LLC and/or its subsidiaries and affiliates.
- "Public Website" or "Public Websites" means AssetView’s public, marketing, and informational websites that link to or display this Policy, including www.assetview.com and other public-facing pages owned or operated by AssetView. AssetView Services are not considered Public Websites.
- "Services" means client.assetview.com and any other AV product or service that requires login or is governed by the AssetView License Agreement and the AssetView Products and Services Privacy Policy.
- "Personal Data" means information collected via the Public Website that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked (directly or indirectly) with an individual or household.
- “Open-Source Software” means software components, libraries, frameworks, or code made available under open-source licenses that may be included in, incorporated into, distributed with, or used in connection with the Public Websites.

Availability
We aim to keep the Public Website accessible 24 hours a day, 7 days a week. However, access may be temporarily suspended due to maintenance, migration, updates, system issues, or Internet/network constraints. To the maximum extent permitted by law, AV disclaims liability for unavailability, interruptions, or delays in access to the Public Website.

Intellectual Property Rights
AV is the owner (or authorized licensee) of the Public Website and the Content made available by AssetView through the Public Website, and retains all intellectual property rights related to the Public Website and such Content, excluding any third-party software components (including Open-Source Software) and other third-party materials that may be included in or used in connection with the Public Website, which are owned and licensed by their respective providers under their applicable terms or open-source licenses. Any content presently displayed or made available by AV in the future—such as text, logos, graphics, images, audio, digital downloads, and data compilations (collectively, “Content”)—is protected by United States and international intellectual property laws.
AV’s names and logos are trademarks of AV. You agree not to copy, reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any Content or trademarks except as expressly permitted by AV in writing. You may not use AV’s trademarks in a manner that could cause confusion, imply endorsement, or disparage or discredit AV.
Open-Source Software
The Public Website may include or use Open-Source Software. Open-Source Software is licensed under their applicable open-source licenses. To the extent this Policy conflicts with an applicable open-source license for Open-Source Software, the Open-Source Software license controls solely with respect to that Open-Source Software. Any required notices or license texts for Open-Source Software may be made available through the Public Website or on AV Websites (including /legal) and are provided for notice purposes.

Information on the Public Website is provided for general informational, educational, and entertainment purposes only and does not constitute legal, tax, financial, investment advice, or investment research and it is not intended to be, and should not be construed as, a recommendation, inducement, offer, or invitation to buy, sell, or hold any security or asset, or to engage in any investment activity or strategy. Acceptable Use; Prohibited Conduct

You agree not to (and not to attempt to): (a) access, scrape, crawl, harvest, or collect data from the Public Website using automated means (including bots, spiders, scrapers, or offline readers) except as except as expressly permitted by applicable law or with our prior written consent; (b) probe, scan, or test the vulnerability of the Public Website or any AssetView systems, or attempt to breach security or authentication measures; (c) interfere with, disrupt, or degrade the Public Website or related systems, including by introducing malware, conducting denial-of-service attacks, or attempting to bypass rate limits; (d) impersonate any person or entity, misrepresent your affiliation with AssetView, or provide false information; (e) use the Public Website in a manner that infringes or violates the rights of others, including intellectual property, privacy, or publicity rights; or (f) use the Public Website to transmit unlawful, harmful, or deceptive content. AssetView may suspend or block access to the Public Website at any time if we reasonably believe your use violates this Policy or could harm the Public Website, AssetView, or others. For clarity, nothing in this section is intended to restrict rights you may have under applicable open-source licenses with respect to Open-Source Software.

Website Content; “As Is” Disclaimer
The Public Website and all content, materials, and information made available through it are provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by law, AssetView disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, availability, or freedom from errors. AssetView does not warrant that the Public Website will be uninterrupted, timely, secure, or error-free, or that defects will be corrected.

Limitation of Liability
To the maximum extent permitted by law, AssetView and its affiliates, officers, directors, employees, agents, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or use, arising out of or related to your access to or use of (or inability to access or use) the Public Website, even if advised of the possibility of such damages. To the maximum extent permitted by law, AssetView’s total liability for all claims related to the Public Website will not exceed the amount you paid to us for use of the Public Website ($0).

Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless AssetView and its affiliates, officers, directors, employees, agents, and service providers from and against any claims, liabilities, damages, judgments, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Public Website; (b) your violation of this Policy; or (c) your violation of any rights of another person or entity.

Governing Law; Venue
This Policy (including these Website Terms) is governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Except where prohibited by law, you agree that any dispute arising out of or relating to the Public Website or this Policy will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts.

Personal Data Collected on Public Websites
The Public Website may collect information including, without limitation: your name (if you provide it), email address (if you submit it), cookie and similar technology identifiers, device or session identifiers, IP address, pages viewed, clicks and actions, referral URLs, and technical/device information (such as browser/OS type, version, and language).
AV uses Personal Data for purposes including:
- operating, maintaining, and improving the Public Website;
- understanding usage and performance (analytics);
- providing requested features and responding to inquiries;
- maintaining security and preventing fraud, abuse, and misuse; and
- supporting marketing and advertising efforts (where applicable).
AV may share Personal Data with:
- Internal personnel. AV employees and authorized personnel, only as needed for the purposes described above and subject to access controls and confidentiality obligations.
- Service providers. Third-party contractors, affiliates, subsidiaries, and other service providers that perform services on AV’s behalf, only as needed for the purposes described above. - Legal and safety. In response to a subpoena, court order, or other lawful governmental request; where required or permitted by law; or when AV believes in good faith that disclosure is reasonably necessary to protect the rights, property, or safety of AV, our users, third parties, or the public.
For clarity, we do not sell Personal Data for money. Depending on your browser settings and choices, we may permit certain third-party analytics and advertising partners to collect information through cookies/pixels to measure ad performance or deliver ads, which may be considered “sharing” as defined under applicable law for cross-context behavioral advertising under some state privacy laws.
AV may retain Personal Data only as long as reasonably necessary for the purposes described in this Policy, unless a longer retention period is required or permitted by law, or needed for security, fraud prevention, dispute resolution, or enforcement of this Policy.
The Public Website may contain links to third-party websites not operated by us. AV does not control and is not responsible for the content, privacy policies, or practices of third-party sites, products, or services.
